GA-0260 — Grandparent Access Statute (Troxel Standards)

In October 2004, Senator Jeff Wentworth requested an Attorney General Opinion from Greg Abbott regarding Texas Family Code § 153.433. The AG determined the statute is constitutional in application only if construed in light of the federal constitutional presumption that fit parents act in their children's best interests.
